By creating an account, purchasing or enrolling in a course, or otherwise using the Website, you agree to be bound by these Terms and Conditions. If you do not agree with these Terms, you should not use the Website or its services.
1. Definitions
“Website” means isihgloballearning.com and its associated online services.
“Platform” means the ISIH GLOBAL LEARNING online learning environment through which courses and related services are provided.
“Course” means any online course, training programme, tutorial, assessment or other educational content made available through the Platform.
“Learner” or “User” means any person who visits the Website, creates an account, purchases, receives access to, or participates in a Course.
“Company”, “we”, “us” or “our” means IRINGA STRATEGIC INVESTMENT HOLDINGS LIMITED, operating the ISIH GLOBAL LEARNING platform.
2. Eligibility and Accounts
Users must provide accurate, complete and current information when creating an account or purchasing a Course.
Where a Learner is below the legal age required to enter into a binding agreement in their jurisdiction, the Learner must use the Platform with the consent and supervision of a parent or legal guardian.
Account credentials are personal and must not be shared with another person. Users are responsible for maintaining the confidentiality and security of their login credentials and for activities conducted through their accounts.
We reserve the right to suspend or terminate accounts that contain false information, are used fraudulently, are shared without authorisation, or otherwise violate these Terms.
3. Courses and Enrolment
Course descriptions, learning objectives, duration, modules, assessments and other information may vary between Courses.
Access to a Course is granted to the Learner associated with the relevant enrolment or purchase and may not be transferred, resold or shared unless expressly authorised by ISIH GLOBAL LEARNING.
Course availability and content may be updated where reasonably necessary to maintain, improve or administer the learning service.
4. Prices and Payments
Course prices are displayed on the Website and may vary between Courses, promotions, countries, currencies or customer categories.
The price displayed and confirmed during checkout will apply to the relevant transaction, subject to correction of obvious pricing or technical errors.
Payments must be made through payment methods made available on the Website. Authorised third-party payment service providers, banks, card networks or mobile payment providers may provide payment processing.
Any applicable bank, card, foreign-exchange, mobile-money or payment-provider charges that are not included in the displayed Course price may be charged separately by the relevant provider.
ISIH GLOBAL LEARNING reserves the right to change Course prices or promotional offers. A subsequent price change will not normally affect a purchase already completed.
5. Course Access
Course access begins after successful enrolment, confirmed payment, authorised assignment or another approved method of registration.
Access periods may vary depending on the Course or offer. Any specific access period stated on the Course page or at the time of purchase will form part of the Learner’s enrolment conditions.
Learners are responsible for having a suitable internet connection, compatible device and software necessary to access online learning materials.
6. Certificates
Where a Course includes a certificate, the certificate will be issued only after the Learner satisfies the applicable completion requirements.
Certificates confirm completion or achievement according to the requirements of the relevant Course. They do not, unless expressly stated, constitute a university degree, professional licence, government licence, employment guarantee or authority to practise a regulated profession.
Learners must ensure that the name and other details associated with their account are correct before a certificate is issued.
We reserve the right to withhold, revoke or correct a certificate obtained through fraud, impersonation, manipulation of assessments or other misuse of the Platform.
7. Refunds and Cancellations
ISIH GLOBAL LEARNING offers eligible Learners a 14-Day Money Back Guarantee, subject to the eligibility conditions, exclusions and procedures set out in our 14-Day Money Back Guarantee & Refund Policy.
To qualify for a refund, a refund request must be submitted within fourteen (14) calendar days from the original date of purchase, and the Learner must have completed no more than 5% of the Course at the time the refund request is submitted.
The Learner must not have completed the Course or obtained, downloaded or otherwise received a Course completion certificate. The relevant account must also show no evidence of misuse, unauthorised sharing, copying, downloading, recording, redistribution or other abuse of Course content.
The purchase must have been made directly through ISIH GLOBAL LEARNING or through an authorised payment method accepted on the Platform. The Learner must provide information reasonably required to verify the purchase and process the refund request.
Refund requests that do not satisfy these requirements may be ineligible for the 14-Day Money Back Guarantee, subject always to any rights or remedies that cannot lawfully be excluded under applicable law.
Where a refund is approved, it will be processed in accordance with the procedures stated in our Refund Policy and the applicable payment method or payment service provider.
Nothing in this 14-Day Money Back Guarantee limits, excludes or replaces any cancellation, refund of other consumer right available under applicable law. Where applicable law provides a consumer with rights that are more favourable than the conditions of this Guarantee, the applicable statutory rights shall prevail.
The complete eligibility requirements, non-refund procedure applicable to our commercial 14-Day Money Back Guarantee are contained in our 14-Day Money Back Guarantee & Refund Policy, which should be read together with these Terms and Conditions.
8. Intellectual Property
The Website, Course materials, videos, graphics, assessments, documents, logos, trademarks, software and other content made available through the Platform may be owned by IRINGA STRATEGIC INVESTMENT HOLDINGS LIMITED, its licensors, Course providers or other authorised rights holders.
Purchasing or enrolling in a Course gives the Learner a limited, personal, non-exclusive and non-transferable right to use the Course materials for authorised learning purposes. It does not transfer ownership of intellectual property.
Users may not reproduce, copy, distribute, resell, publish, record, upload, commercially exploit or otherwise make Course materials available to third parties without appropriate written authorisation.
9. Prohibited Use
Users must not misuse the Platform, attempt unauthorised access, interfere with its security, introduce malicious software, share accounts unlawfully, copy protected Course materials, commit payment fraud, impersonate another person, manipulate assessments or certificates, or use the Platform for unlawful purposes.
We may suspend or terminate access where we reasonably believe these Terms have been materially violated.
10. Third-Party Services and Content
Some Courses, technologies, payment services, accreditation services or other resources may be supplied or supported by third parties.
Where appropriate, third-party terms may also apply to those services. ISIH GLOBAL LEARNING is not responsible for independent third-party websites or services outside its reasonable control, subject always to obligations imposed by applicable law.
11. Platform Availability
We aim to maintain reliable access to the Platform, but uninterrupted or error-free operation cannot be guaranteed.
Access may occasionally be affected by maintenance, updates, internet failures, hosting issues, security requirements, third-party service interruptions or circumstances beyond our reasonable control. Where reasonably practicable, we will seek to restore affected services promptly.
12. Limitation of Liability
To the maximum extent permitted by applicable law, ISIH GLOBAL LEARNING and IRINGA STRATEGIC INVESTMENT HOLDINGS LIMITED shall not be liable for indirect, incidental, special or consequential losses arising from the use of, or inability to use, the Website, Platform or Courses, particularly where such loss results from circumstances outside our reasonable control.
Nothing in these Terms and Conditions excludes or limits any liability, consumer right or legal remedy that cannot lawfully be excluded or limited under applicable law.
13. Privacy and Personal Data
ISIH GLOBAL LEARNING respects the privacy of its Users and processes personal information in accordance with its Privacy Policy and applicable data protection requirements.
Personal information may be collected and processed for purposes including account creation and administration, Course enrolment, payment processing, delivery of learning services, monitoring of learning progress, assessment, certification, customer support, security, fraud prevention and compliance with applicable legal obligations.
Users should review the ISIH GLOBAL LEARNING Privacy Policy for further information regarding the collection, use, storage and protection of personal information.
14. Assessments and Academic Integrity
Learners are expected to complete assessments, quizzes, examinations and other learning activities honestly and in accordance with the requirements of the relevant Course.
Cheating, impersonation, unauthorised assistance, manipulation of assessment results or any attempt to obtain a certificate dishonestly is prohibited.
ISIH GLOBAL LEARNING reserves the right to investigate suspected academic misconduct and, where reasonably established, may invalidate assessment results, suspend Course access or revoke a certificate.
15. Professional and Regulatory Requirements
Certain Courses may relate to professions, industries or activities that are regulated differently between countries and jurisdictions.
Unless expressly stated otherwise, completion of a Course does not by itself grant a university degree, professional licence, statutory qualification, immigration status, employment entitlement or legal authority to undertake a regulated activity.
Learners are responsible for determining whether a Course or certificate satisfies the requirements of an employer, professional body, educational institution, regulator or other organisation relevant to their intended purpose.
16. Accreditation and Certification Information
Where a Course or certificate is described as accredited, endorsed, recognised or quality assured by a third-party organisation, such status applies only to the extent expressly stated for that particular Course.
Accreditation, endorsement or recognition of a particular Course must not be interpreted as accreditation of every Course offered through ISIH GLOBAL LEARNING or of the Platform itself unless expressly stated.
Third-party accreditation or certification arrangements may remain subject to the requirements, standards and continuing approval of the relevant accreditation or quality-assurance organisation.
17. Course Information and Updates
ISIH GLOBAL LEARNING endeavours to ensure that Course descriptions, prices, durations, learning outcomes and other information displayed on the Website are accurate and current.
Course content may nevertheless be updated, replaced or reorganised where reasonably necessary to improve quality, maintain relevance or reflect changes in professional practice, technology or applicable requirements.
Where a material change affects a Course already purchased or assigned to a Learner, reasonable steps will be taken to minimise unnecessary disruption to that Learner.
18. Promotions, Discounts and Promotional Codes
ISIH GLOBAL LEARNING may from time to time offer promotional prices, discounts, vouchers, coupon codes or other special offers for selected Courses or categories of Learners.
Promotions may be subject to specific eligibility requirements, validity periods, usage limits or other conditions stated at the time of the offer.
Unless otherwise expressly stated, promotional offers cannot be exchanged for cash and may not be combined with other promotions. ISIH GLOBAL LEARNING reserves the right to amend or withdraw promotional offers where permitted by applicable law, without affecting purchases already validly completed.
19. Corporate and Organisational Customers
ISIH GLOBAL LEARNING may provide Courses and learning services to companies, government institutions, educational institutions, non-governmental organisations and other organisations.
Where an organisation purchases, sponsors or assigns Courses to its employees, students, members or beneficiaries, additional commercial or contractual terms may apply between ISIH GLOBAL LEARNING and that organisation.
Individual Learners receiving Courses through an organisation remain responsible for complying with applicable learner conduct, account security and academic integrity requirements.
20. Technical Requirements and Learner Responsibility
Learners are responsible for maintaining suitable internet access, compatible devices, browsers, software and other technical facilities reasonably necessary to access the Platform and Course materials.
ISIH GLOBAL LEARNING is not responsible for technical failures caused solely by a Learner’s device, internet service provider, unsupported software or equipment outside our reasonable control.
Learners experiencing a technical problem that reasonably appears to originate from the Platform should contact ISIH GLOBAL LEARNING through the official support channels.
21. Account Security
Learners must take reasonable steps to protect their usernames, passwords and other account credentials and must not knowingly permit unauthorised persons to use their accounts.
Users should notify ISIH GLOBAL LEARNING promptly if they become aware of or reasonably suspect unauthorised access to their accounts.
ISIH GLOBAL LEARNING may temporarily restrict or suspend an account where reasonably necessary to investigate suspected fraud, unauthorised access, security threats or other misuse of the Platform.
22. Communications
By creating an account, enrolling in or purchasing a Course, Users acknowledge that ISIH GLOBAL LEARNING may send communications reasonably necessary for the provision and administration of its services.
Such communications may include account notifications, payment confirmations, enrolment information, Course-access information, learning-progress notifications, certificate information, security alerts, customer-support communications and important service updates.
Marketing and promotional communications will be handled in accordance with applicable law and the communication preferences made available to Users.
23. Reviews, Feedback and User Content
Where Users are permitted to submit reviews, ratings, comments, testimonials or other content through the Platform, such content must be lawful and must not infringe the intellectual property, privacy or other rights of another person.
Users must not knowingly submit fraudulent, defamatory, abusive, misleading or otherwise unlawful content.
ISIH GLOBAL LEARNING reserves the right to moderate, restrict or remove User-submitted content where reasonably necessary to protect Users, enforce these Terms, comply with applicable law or maintain the integrity of the Platform.
24. External Links and Third-Party Websites
The Website may contain links to third-party websites, applications or resources for convenience, payment processing, educational purposes or access to related services.
Unless expressly stated otherwise, the inclusion of an external link does not constitute an endorsement or guarantee of the relevant third party, its products or its services.
Third-party websites and services may be governed by their own terms, privacy policies and security practices. Users should review those terms before using the relevant third-party service.
25. Force Majeure
To the extent permitted by applicable law, ISIH GLOBAL LEARNING and IRINGA STRATEGIC INVESTMENT HOLDINGS LIMITED shall not be responsible for a delay or failure to perform an obligation where performance is prevented or materially affected by circumstances beyond their reasonable control.
Such circumstances may include natural disasters, major telecommunications or internet failures, widespread infrastructure failures, governmental actions, civil disturbances, epidemics or pandemics, cyber incidents affecting third-party infrastructure, or other comparable events beyond reasonable control.
Where reasonably practicable, appropriate steps will be taken to restore affected services and minimise disruption.
26. Suspension and Termination
ISIH GLOBAL LEARNING may suspend, restrict or terminate a User’s access to the Platform where the User materially breaches these Terms, engages in fraudulent or unlawful activity, compromises Platform security, infringes intellectual property rights, abuses the learning service or improperly obtains or uses certificates.
Where appropriate and reasonably practicable, the User may be informed of the reason for such action.
Suspension or termination does not affect rights or obligations that arose before the effective date of the suspension or termination.
27. Changes to These Terms and Conditions
ISIH GLOBAL LEARNING may update these Terms and Conditions where reasonably necessary to reflect changes in its services, technology, business operations, payment arrangements or applicable legal and regulatory requirements.
The current version will be published on the Website together with its latest revision date.
Where applicable law requires specific notice or consent for a material change, ISIH GLOBAL LEARNING will take reasonable steps to provide such notice or obtain such consent.
28. Governing Law and Dispute Resolution
These Terms and Conditions shall be governed by and interpreted in accordance with the applicable laws of the United Republic of Tanzania, without prejudice to any mandatory rights that may apply to a consumer under the laws of another jurisdiction.
If a dispute or complaint arises, the User is encouraged to contact ISIH GLOBAL LEARNING first so that the matter can be reviewed and, where possible, resolved amicably.
Where a dispute cannot be resolved through an appropriate internal resolution process, the matter may be referred to the competent courts, regulatory authorities or other legally recognised dispute-resolution mechanisms in accordance with applicable law.
29. Severability
If any provision of these Terms and Conditions is determined by a court or other competent authority to be invalid, unlawful or unenforceable, that provision shall be treated as modified or severed to the extent necessary, while the remaining provisions shall continue in effect to the extent permitted by law.
30. No Waiver
Failure or delay by ISIH GLOBAL LEARNING or IRINGA STRATEGIC INVESTMENT HOLDINGS LIMITED to exercise or enforce any right or provision under these Terms does not constitute a permanent waiver of that right or provision.
31. Entire Agreement
These Terms and Conditions, together with the Privacy Policy, applicable refund or cancellation terms, and any additional terms expressly presented in connection with a particular Course, promotion or transaction, constitute the applicable terms governing the User’s use of the Platform, subject to mandatory rights under applicable law.
